Dies ist z.B durch die Wahl des Bildausschnitts und des Zeitpunkts des Auslösens, durch die Einstellung von Schärfe und Belichtung sowie durch die Bearbeitung des Negativs möglich. Nicht geschützt ist somit (unabhängig vom Gegenstand) eine Fotografie, die den Gestaltungsspielraum weder in fototechnischer noch in konzeptioneller Hinsicht ausnutzt, sondern sich vom allgemein Üblichen nicht abhebt.
